It also hasn't been established that TV guide data is protected by copyright at all. Even if it is, Shepherd doesn't copy or distribute data, but rather allows individuals at home to read it via their PVRs. It seems unlikely that it could be legal to read an online TV guide via your computer if you're holding a mouse but not a remote control.
